The Department of Environmental Protection (DEP) was created by Act 1995-18 which split the Department of Environmental Resources (DER) into DEP and the Department of Conservation and Natural Resources. The statute designated DEP as the renamed Department of Environmental Resources, and DEP received a blanket transfer of all basic powers and duties of that discontinued department not specifically assigned to the Department of Conservation and Natural Resources. DER's authority over state forests, parks, and outdoor recreational facilities was given to Conservation and Natural Resources, so that DEP is not directly involved in administering public properties. The department is charged with responsibility for development of a balanced ecological system incorporating social, cultural, and economic needs of the Commonwealth through development and protection. It is responsible for the state's land, air, and water management programs, as well as other aspects of environmental protection, and the regulation of mining operations.
